
SHERIDAN, WYOMING – November 5, 2024 – In a move that could have significant implications for the fitness industry, the U.S. Department of Justice (DOJ) has filed a lawsuit against LA Fitness, the nation's largest gym chain, alleging violations of the Americans with Disabilities Act (ADA). The lawsuit, filed in the Central District of California, accuses LA Fitness of failing to provide equal access to its facilities and equipment for members with disabilities.
According to the DOJ, LA Fitness has been neglecting to maintain essential equipment like pool lifts and elevators, creating significant barriers for members who rely on them. The lawsuit cites the case of "Patron A," a woman with multiple sclerosis who has experienced inoperable pool lifts at her local LA Fitness.
"Even when a pool lift appears to be working, Patron A has experienced being stuck and dangling over the water, requiring assistance from LA Fitness employees to exit the pool, and being unable to use the pool," the DOJ alleges. This is just one example of how broken equipment can significantly hinder a person's ability to participate in fitness activities.
The lawsuit further claims that LA Fitness has not adequately addressed these issues despite complaints from members. This lack of responsiveness is a key point of contention for the DOJ.
"Access to physical fitness activity is crucial for promoting the health and well-being of all Americans, including those with disabilities," stated Assistant Attorney General Kristen Clarke of the Justice Department's Civil Rights Division. The ADA has been in place for over 30 years, prohibiting gyms from denying access to people with disabilities. Through this lawsuit, the DOJ seeks to dismantle these discriminatory barriers and ensure that everyone has the opportunity to participate in fitness activities at LA Fitness.
U.S. Attorney Martin Estrada for the Central District of California echoed these sentiments, emphasizing the importance of accessibility. "Our office is committed to upholding the protections of the ADA and ensuring that public accommodations are accessible to all," Estrada said. "When we support those with disabilities, the entire community benefits."
The lawsuit seeks a court order requiring LA Fitness to make its facilities and equipment accessible. Additionally, the DOJ is requesting monetary damages for individuals who have been harmed by the alleged discrimination. This could include compensation for those who were unable to use the gym due to broken equipment or who incurred additional costs due to needing assistance.
